(TTS), through this web platform (hereinafter, interchangeably referred to as "the platform," "the website," or "the web platform"), provides information to its users about its corporate identity, activities, products, and services. Additionally, it offers various products and services for sale through the platform, whether they are its own or third-party products.

The information contained on the platform regarding TTS, its products, and services is intended to be current at the time of publication, striving to be accurate and precise at all times, updated as quickly as possible, and attempting to avoid errors, correcting them as soon as they are detected. TTS authorizes users to use, view, print, download, and store the website and its contents lawfully and legitimately, provided that it is compatible with its purposes, is done with the sole aim of obtaining the contained information for the exclusive, personal, and private use of the user – expressly prohibited, among other things, its use for commercial purposes, especially its distribution, public communication, transformation, or decompilation, as well as for the performance of any practice or act of imitation or unfair competition –, its integrity is maintained, and it is not modified or transformed – expressly prohibited, among other things, the use, copying, or distribution of graphics, distinctive signs, icons, or images available on the website separately from the text or other accompanying images –, and, in any case, provided that the origin and/or author thereof are indicated and, where appropriate, the copyright symbol and/or industrial property notices of their owners appear. The use of such elements, their reproduction, communication, and/or distribution for commercial or lucrative purposes, as well as their modification, alteration, or decompilation, are strictly prohibited. For any other use not expressly permitted, it will be necessary to obtain the prior written consent of the rights holder in question.

Unauthorized use of the information contained on the website and/or its contents, its resale, as well as the infringement of TTS's intellectual or industrial property rights or its image in the market, will entail the demand for legal responsibilities that may arise before the competent national or international bodies and courts.

TTS, aware of the risks derived from facing the new challenges posed by the provision of services or the use of applications or communication tools through communication networks, especially the Internet, has implemented stringent security measures to reduce such risks. However, TTS cannot guarantee the absolute invulnerability of its security systems, so it excludes any liability for damages of any nature that may arise from the presence of viruses or other elements that may alter the computer system (software and hardware), terminals, electronic documents, and files of the user or any third party. TTS cannot guarantee the download of the contents made available to the user on this website through other distribution channels, authorized or not by the same.

The user is informed that the use of electronic data transmission systems, email, and sending messages to mobile phones through technological platforms do not offer absolute security guarantees. TTS and the user mutually exempt each other from any liability arising from events such as non-receipt or delay of the same, error, or interception of communications.

Access to the application and associated tools, as well as the unauthorized use that may be made of the information and contents thereof, is the sole responsibility of the user. TTS will not be responsible for any consequences, damage, or harm that may arise from such access or use.

2.7. Exclusion of Warranties and Liability

In order to reduce the risk of introducing viruses on the website, TTS uses virus detection programs to control all contents introduced on the website. However, TTS does not guarantee the absence of viruses or other elements on the website introduced by third parties unrelated to TTS that may alter the physical or logical systems of users or the electronic documents and files stored on their systems, especially if it concerns contents distributed by third parties. TTS adopts various protection measures to protect the website and its contents against third-party computer attacks. TTS is not responsible for failures that occur in communications and networks, not guaranteeing the availability and continuity of the operation of the platform, associated tools, and services. Therefore, TTS does not guarantee the absence of interruptions or errors in accessing the platform, associated tools, utilities, or their content, nor that all of them are permanently updated. TTS will carry out, whenever it is within its competence and there are no reasons that make it impossible or difficult to execute, and as soon as it becomes aware of errors, disconnections, or lack of updating, all those tasks aimed at correcting errors, restoring communication, and updating the tool.

Exclusion of warranties and liability for the use of the website, contents, applications, and/or related services. TTS does not generally control the use that users make of the website and its contents, products, and applications. TTS does not guarantee or be responsible in any case for the use that users and/or third parties may make of the website, its contents, applications, products, or related services, nor for any damages and harms that may arise therefrom.

Exclusion of warranties and liability for contents. TTS does not guarantee or be responsible for the suitability of each of the contents and products published on the website for specific user profiles of the website. TTS does not edit third-party content published on the website; therefore, it does not guarantee or be responsible for the legality, reliability, usefulness, truthfulness, accuracy, completeness, and timeliness of such contents and products. TTS will not be responsible in any case for any damages and harms that may arise from: a) The lack of legality, reliability, usefulness, truthfulness, accuracy, completeness, and/or timeliness of third-party contents and products; b) Inadequacy for any purpose and disappointment of the expectations generated by the contents or products; c) Decisions or actions taken or avoided by the user relying on the information or data provided in the contents and products, including without limitation the loss of profits or business opportunities.

TTS will not be responsible in any case for any special or indirect damages, or for any other damages resulting in a loss of use, data, or profits, nor in a legal action for contract, negligence, or any other type, derived from or related to the use, performance, or information available on the website.

3. General terms and conditions of sale and supply

These general terms and conditions of sale and supply regulate the purchase of products and the contracting of services offered by The Time Seller, S.L.U. through the web platform "thetimeseller.com".

The use of the platform, its options, tools, and utilities, or the request and contracting of products or services integrated therein, implies the full acceptance and without reservation of the following general conditions:

3.1. Acceptance and availability of these general terms and conditions of sale and supply

The placement of any order implies acceptance of these terms and that the user is of legal age (18 years old) and has the capacity to contract and has read and accepted these general conditions.

These general conditions (hereinafter, "the General Conditions") govern the legal relationship arising from the processes of ordering and contracting products and services by the users-customers (hereinafter, "the Customers") through The Time Seller, S.L.U. website (hereinafter "TTS"). Customers accept them in their entirety from the moment they place an order. This document can be printed and stored by Customers. TTS provides Customers with the email address pedidos@thetimeseller.com and the telephone number 961050517 so they can raise any questions about the General Conditions.

3.2. Applicable rules

These General Conditions are subject to the provisions of current legislation, especially Law 7/1998, of April 13, on General Conditions of Contracting, Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, General Data Protection Regulation (EU) 2016/679, Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, Law 7/1996, of January 15, on Retail Trade Organization, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

If you reside outside the EU and under your local legislation different rules apply than the Spanish legislation indicated, you should not make purchases through this platform, which is subject to said regulations.

3.3. Modification of the General Conditions

TTS may modify the General Conditions in the future in order to improve them, as well as to adapt them to its corporate policies, regulatory requirements, and codes of good practice to which it may adhere. Any modification will be published with a minimum notice of thirty (30) calendar days prior to the effective date and will not affect any orders already placed or in progress.

3.4. Description of products and services

The products marketed are offered "as is" according to their description, without any warranty of functionality other than that expressly indicated or of satisfaction of specific interests or needs. TTS products that are marketed by purchasing them through our website grant the right of return within fifteen (15) calendar days following the receipt of the order. Returns of products will only be accepted in their original condition and packaging.

Product images often include other related combined products shown to highlight the functionality and final assembly of the original product. The sale only includes the substantive original item mentioned in the product name, not the related or accessory items that may appear in the images to show and highlight their functionality or final assembly.

3.5. Functionality of products

All our items, especially those of references MH-W, MH-K, MH-MI, MH-AR, are historical reproductions not designed to perform the same functions as the originals; they are only intended to imitate the aesthetic appearance and materials of the original, unless expressly indicated in the article description that they are functional.

3.6. Product availability

Product offers and prices will be valid as long as they are published on the platform. Within this framework, indications will be provided regarding the availability of products at the time each order is processed.

3.7. Price and billing data

The price of the products will be specified on the platform at the time of purchase, including VAT or any other applicable tax specified in the order and invoice.

Billing will be carried out according to the data provided by the customer.

The customer must keep TTS informed of any changes related to billing, VAT number, delivery address, contact persons, or any of their relevant data. This communication must be made to TTS in writing via email to pedidos@thetimeseller.com or through the personal administration panel if the customer is a registered user. Any sanction, fine, or tax or any other contingency derived from non-compliance with this obligation or from the lack of updating, accuracy, or alteration of the data provided by the user will be their sole responsibility. In any case, TTS shall not be held responsible in any way for any delay or economic damage or of any nature caused by the aforementioned reasons and, furthermore, reserves the right to exercise the actions available to it in accordance with current legislation.

The prices and data indicated on the platform are valid and current at all times except for typographical, computer errors, or unauthorized alterations, in which case they will be corrected as soon as possible. In the event of a formalized order, the affected customer will be contacted and notified of the error, canceling or modifying the item or order. Any modifications to the prices of the products or their acquisition and supply conditions will not affect orders already placed.

3.8. Shipping costs

The shipping costs of orders will be indicated during the purchase process, estimated based on the weight, volume, destination, and, if applicable, special characteristics of the product, in accordance with the current rates of the transport companies involved in their transportation.

The shipping costs per item are pre-defined by the computer system and may vary once the item/items are confirmed and the final package to be sent to the customer is prepared, depending on the destination and delivery conditions and volume. In case the costs are finally higher than those predefined by the system when placing the order, the customer will be contacted to accept and pay the difference or, if not paid, cancel the order.

Shipping costs, unless expressly stated otherwise, will be borne by the customer, reflected in their order and invoice.

Payment of shipping costs includes the shipment of the order under the agreed conditions with a maximum of two delivery attempts, after which, if the product has not been delivered due to reasons beyond TTS's control or the carrier's, the product may be returned to our warehouse, in which case, the customer must pay again the shipping costs for the new shipment of the product from our warehouses.

Orders over €350 will have no transportation costs for the customer. This offer is only valid for customers and orders to be delivered in the Spanish peninsula territory that are not subject to special rates and is limited to a single shipment per order, so if you wish to receive your items in separate shipments, this gratuity will only apply to the first one, having to pay for the rest of the packages sent as agreed with the TTS team.

Orders destined for Island Europe (such as Corsica or Sardinia) will have an additional charge for re-expedition of €15 plus taxes (€18.15). This amount is not calculated directly by the system, so the customer will be contacted to cover this additional shipping supplement.

The prices and transportation costs shown on the platform for each order are applicable for orders placed and delivered in the Spanish peninsula territory. For orders placed from or for delivery outside the indicated territory, you must contact us in advance at pedidos@thetimeseller.com, where we will inform you of the options, conditions, and process to follow. These orders may incur higher transportation costs, customs duties, or special taxes. If there are special conditions or obligations at the destination of the order, it is the obligation of the person placing the order to know them in advance, as well as to bear the responsibility for complying with such obligations and additional costs. TTS cannot be held responsible for the buyer's lack of knowledge of such conditions and obligations, without prejudice to any particular conditions agreed between the customer and TTS regarding special orders outside the indicated territory. In case of return to origin by the customs authorities of an order processed due to reasons beyond TTS's control, the customer will be entitled to a refund of the product price except for the shipping costs borne by TTS, once the order is received by us.

3.9. Payment

When placing the order, the customer can freely choose to pay for purchases made by Credit or Debit Card, by Bank Transfer, or by PayPal. In certain cases and to prevent possible fraud, TTS reserves the right to request a specific payment method from a customer if the buyer's identity is not convincingly proven.

3.10. Supply and delivery

Unless there are circumstances arising from the customization of the products, or unforeseen or extraordinary circumstances occur, we will send you the order consisting of the product or products related in each Shipping Confirmation within the estimated period on the website and, in any case, within a maximum period of thirty (30) calendar days from the date of the contract.

If for any reason we cannot meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid.

For the purposes of these Conditions, it will be understood that the "delivery" or that the order has been "delivered" at the moment you receive the physical possession of the products at the delivery address, which will be evidenced by the signing of the receipt of the order at the agreed delivery address.

TTS does not accept urgent orders. Orders are processed strictly on a first-come, first-served basis. Any special order or service that requires accelerated action compared to the normal processing of information or orders must be raised with TTS in advance to assess its feasibility and agree on its conditions. Any extraordinary expense or cost not included and related to any order placed will be the responsibility of the customer unless it corresponds to the concepts included therein. The dispatch and supply through means and services other than those ordinarily made available to the customer will always be at the requester's own risk and expense, so TTS will not be liable for the risks and liabilities arising therefrom.

TTS reserves ownership and title of the purchased items until the customer fully satisfies their price, including transportation costs, tariffs, and applicable taxes.

Accepted and confirmed backorders from resellers must be paid within a maximum period of 48 hours from the payment request sent by TTS. If after 48 hours the required amount has not been paid, the order will be canceled.

Orders will be shipped to the shipping address indicated in the user account, unless the payment option used is PayPal, in which case, in accordance with the provisions of PayPal's Service Conditions, the order can only be shipped to the address indicated in the PayPal account used to make the payment.

3.11. Responsibility

The potential liability of TTS for the supplied products is exclusively limited to the amount paid for them. The user or consumer waives any claims of liability against TTS for any reason related to the incorrect, inappropriate, or improper use of the items offered on the website, as well as for any dissatisfaction with the purchased products or for possible failures, slow access, or errors in accessing the platform, including data losses or any other type of information that may exist on the server, equipment, device, or network of the user accessing the platform.

Resellers using TTS services are required to maintain a minimum resale price stipulated to avoid damaging the market and TTS's commercial interests. The stipulated sale price is the one indicated on TTS's website as the public price.

Failure to comply with any of these conditions by the customer or reseller may result in the loss of such condition and deactivation, as well as the exercise of any necessary legal action.

3.12. Product Returns

3.12.1. Right of Withdrawal

In accordance with applicable legislation and our corporate policies, the customer has a period of fifteen (15) calendar days from the delivery of the product to communicate their total or partial withdrawal from the purchase of the Product. Once the fifteen (15) calendar days have elapsed, TTS will not accept returns for withdrawal from product purchases. Returns made within the deadline will not entail any penalty.

In the event that multiple goods are purchased in the same order and delivered separately, the withdrawal period will expire fifteen (15) calendar days after the delivery of the last product.

In the case of a product composed of multiple components or pieces, the withdrawal period will expire fifteen (15) calendar days after the delivery of the last component or piece.

In accordance with the provisions of current legislation, the Customer shall not have the right to withdraw from contracts concerning the supply of goods made to the consumer's specifications or clearly personalized, the supply of goods liable to deteriorate or expire rapidly, the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery, the supply of goods which, after delivery and taking into account their nature, have been inseparably mixed with other items, the supply of sealed audio or video recordings or sealed software which have been unsealed by the consumer after delivery, the supply of digital content which is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer with the knowledge on their part that they thereby lose their right of withdrawal.

The customer must communicate the return to the following address: pedidos@thetimeseller.com where precise instructions on the process to follow will be provided. Subsequently, TTS will contact the customer to indicate the steps to follow for the return. The user must return the product(s) within a maximum period of fourteen (14) calendar days from the date TTS indicates the return method.

Returns outside the aforementioned period will not be accepted. Nor will the amount of any product damaged by the customer or whose original packaging is damaged beyond simple opening be refunded; or it will be only partially refunded. In all cases, the products subject to return must be in perfect condition.

3.12.2. Price Refund

In the event of exercising the right of withdrawal, the Customer shall be entitled to a refund of the price of the returned Products, in addition to ordinary shipping costs, provided that the returned Products are in the same conditions as they were delivered, have not been used, washed, damaged, unsealed, or lost before reaching TTS's premises, or the requirements set forth herein have not been met. Conditions of Sale. The direct costs of returning the product shall be borne by the Customer.

TTS will check the adequacy of the returned Product in its warehouse, reserving the right not to refund in case it detects that the purchased and returned Product do not match or that the return has not been made in accordance with these Conditions of Sale. Partial voluntary returns of an order will result in partial refunds of the price and shipping costs. Shipping costs will be refunded in proportion to the value of the returned Product. Returns for the entirety of an order will entail the refund of shipping costs for the entirety of the expenses paid.

TTS will manage the refund of the price and shipping costs using the same payment system used by the Customer for the purchase of the Products, within forty-eight (48) hours from the confirmation of the arrival of the returned order at the warehouse and, in any case, within a period not exceeding fourteen (14) calendar days from the Customer's communication of withdrawal. However, the effective application of the refund of the price and shipping costs to the Customer's account or card will depend on the card and the issuing entity. The refund period may take up to seven (7) calendar days for debit cards and up to thirty (30) calendar days for credit cards

If the Customer has chosen a delivery method other than the least expensive ordinary delivery, in which case the additional costs derived from this will not be refunded.

3.12.3. Return of Defective Products

The Customer shall be entitled to the refund of the price, shipping costs, and return transportation costs of defective Products or Products delivered if they do not correspond to the order placed by the Customer, in accordance with applicable law.

The warranty and liability for product defects do not extend to the product's factory box or packaging, to the extent that they are intended to contain it and protect it, so they do not cover any damages that boxes and packaging may present, especially during handling and transportation until delivery to the recipient, provided that the product inside corresponds to the purchased one and does not present defects. 3.13. Warranty of Purchased Products

The Products have the legal warranty for lack of conformity that manifests itself within a period of two (2) years from the delivery date and in accordance with the provisions of the applicable regulations. The Customer must inform TTS of the lack of conformity within two (2) months from becoming aware of it and, in any case, before the expiration of the legal warranty period of the product.

The warranty offered by TTS corresponds to that established in Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users.

The warranty does not include deficiencies caused by negligence, impacts, improper use or handling, unsuitable voltage, electrical accidents, installation and/or use not in accordance with the instructions for use or not carried out by the authorized technical service when applicable, nor perishable materials or Products, subject to wear and tear due to normal use or being consumables. Products modified or repaired by the Customer or any other person not authorized by the technical support service are excluded from the warranty.

The Customer shall not have the right to exercise the warranty:

a) If they lack proof of purchase of the Products. To use the warranty, it is essential to keep the proof of purchase of the Products.

b) If the identification number is tampered with or repaired, as well as the warranted Product without the knowledge and authorization of the technical service or the issuing company of the warranty.

c) If some of the warranty data of the Products provided or the proof of purchase of the Products are modified, altered, or replaced.

In the event that the manufacturer grants additional commercial guarantees to the legal warranty, for their exercise, it will be necessary to keep the corresponding warranty certificate.

The Customer must follow, at all times, the information leaflet of the Product and the instructions for proper use and, where appropriate, installation of the Product, as well as all the information provided for the exercise of the legal (and commercial, if any) warranty.

The Customer may exercise the warranty of a Product in accordance with current regulations, for which they may contact TTS through the address pedidos@thetimeseller.com.

If a Product is non-compliant, TTS cannot guarantee that it can be replaced, as it may be limited stock or discontinued or discontinued products by the manufacturer. However, if the requirements indicated by the current consumer law are met, TTS will refund the Customer a part or the entirety of the price of the non-compliant Product, according to the conditions of the Product and as agreed with the Customer.

3.14. Policy on Uncollected Orders

Once the orders have been dispatched from The Time Seller SLU, they are made available to a courier company, which will be responsible for delivering the package

It is very important to know that courier companies will attempt delivery of the order only twice at the specified address. To avoid failed delivery attempts due to the customer's absence at their home, it is of great importance that, either in the order notes or in the customer's account, a contact phone number be provided that TTS can provide to the courier company, so they can contact the customer and notify the future delivery or agree on a new suitable date and time for the delivery to avoid failed attempts.

3.14.1 Failed Delivery Attempts

Once the two delivery attempts have failed, the courier company will leave a receipt with a note to indicate this and will proceed to deposit the package at its nearest distribution center, so that the customer themselves can pick it up within the timeframe and hours indicated in the note left at the address.

3.14.2 Time Elapsed without Pickup and Return to TTS

If the deadline has elapsed and the customer has not proceeded to pick up the package, the courier company will return it to TTS.

3.14.3 Reshipment of the Order and Shipping Costs

If the customer wishes to have the order resent, they must pay the shipping costs again to proceed with resending the order. If the previous order, due to a promotion or offer, had free or reduced shipping costs, the subsequent order after the return will not enjoy such a discount and the full shipping cost must be paid.

3.14.4 Waiver of the Order and Shipping Costs

If the customer waives the order, the purchase amount will be refunded, except for the shipping costs, which will not be refunded, as the courier company has done its job and has been paid accordingly.

3.14.5 Failed Office Pickup

In the case where the selected option is Pickup at Post Offices, the customer should be aware that the order will only be held for fifteen calendar days from the notice for pickup. Again, if the customer does not pick it up within the stipulated period, the case will be exactly the same as described in the previous sections, that is, if it is returned to TTS, and they want it to be resent, the new shipping costs will be charged again, and in the event of the order being canceled, the part of the cost referring to the shipping costs will not be refunded.

4. Common Conditions

4.1. Actions in Case of Non-Compliance

TTS reserves the right to take whatever actions are available to it under the current and applicable law at any given time and case to demand the responsibilities arising from the breach of any of the provisions of these general conditions of website use and/or related services by a user.

4.2. Integrity

The declaration of any of these general access and use conditions as null, invalid, or ineffective will not affect the validity or effectiveness of the remaining conditions, which will remain binding between the parties. The waiver by either party to demand compliance with any of the general conditions stipulated herein at a specific time shall not imply a waiver in general of compliance with any other condition or conditions, nor create an acquired right for the other party.

4.3. Expenses

The expenses and taxes of any nature and kind that accrue from the formalization and elevation to public of this agreement shall be borne by whomever the Law designates.

4.4. Domicile and Notifications

The parties must communicate any change of the address indicated in the header for the purposes of this contract, with the referred addresses being valid and effective until the notification of any change in them becomes effective, for the purposes of any communication or notification between the parties.

4.5. Applicable Law and Competent Jurisdiction

These general conditions of website access and use shall be governed and interpreted in accordance with the laws of Spain. For the resolution of any dispute that may arise from the access and use of the website and the purchase of the products advertised and marketed therein, the user and TTS submit, with express waiver of any other jurisdiction that may correspond to them, to the Courts and Tribunals of the city of Valencia (Spain).
